Terms & Conditions
1. Scope
(1) These Terms & Conditions apply to all orders placed through the online shop of Adela Ceramics, owned and operated by Adela Novotna.
(2) These Terms & Conditions apply to both consumers (Section 13 German Civil Code – BGB) and business customers (Section 14 German Civil Code – BGB).
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
(4) A business customer is any natural or legal person, or a legal partnership, acting in the exercise of their trade, business or profession when entering into a legal transaction.
(5) Any terms and conditions of the customer that differ from these Terms & Conditions shall not apply unless expressly agreed to in writing.
2. Contract Partner and Conclusion of Contract

(2) The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.
(3) By completing the checkout process, the customer submits a binding offer to conclude a purchase contract.
(4) After the order has been received, the customer will first receive an automatically generated order confirmation by email. This confirmation does not yet constitute acceptance of the customer’s offer.
(5) The purchase contract is concluded only when we expressly accept the order by sending an order confirmation by email or by dispatching the ordered goods.
3. Prices and Payment
(1) All prices shown on the website are stated in euros (€) and include the applicable statutory value-added tax (VAT).
(2) Shipping costs apply in addition to the stated product prices. The applicable shipping costs are displayed before the customer completes the order. Further information can be found in the Shipping Policy on this website.
(3) Payment can be made using the payment methods offered in the online shop. The available payment methods are displayed during the checkout process.
(4) Unless otherwise agreed for the selected payment method, the purchase price becomes due immediately upon completion of the order.
4. Delivery and Shipping
(1) Orders are delivered to the shipping address provided by the customer.
(2) We currently ship within Germany and to all member states of the European Union. Shipping to other countries may be available upon request and by individual agreement.
(3) Orders are usually processed and dispatched within 2–5 business days after receipt of payment. During periods of increased demand, attendance at ceramic markets or other exceptional circumstances, processing times may be longer. In such cases, the customer will be informed accordingly.
(4) If, in exceptional cases, individual products become unavailable or delivery is delayed for reasons beyond our control, the customer will be informed without undue delay. If the contract cannot be fulfilled, any payments already made will, of course, be refunded.
(5) For consumers, the risk of accidental loss or accidental deterioration of the goods passes to the customer only upon delivery. For business customers, the risk passes to the carrier upon handover of the goods.
5. Warranty
(1) The statutory warranty rights shall apply.
(2) If the goods are obviously damaged during transport, customers are requested to report such damage to the delivery carrier as soon as possible and to notify us without undue delay. Failure to do so shall not affect your statutory warranty rights but will help us process any claims with the carrier.
6. Nature of Handmade Products
(1) All products by Adela Ceramics are carefully handcrafted. Every piece is unique.
(2) Minor variations in shape, size, weight, colour, glaze, surface texture or firing marks do not constitute defects but are characteristic features of handmade ceramics.
(3) Product photographs are intended to represent the items as accurately as possible. However, due to differences in screen displays and the handmade nature of each piece, colours and surface finishes may vary slightly from the actual product.
7. Custom Orders
(1) Individual custom-made or personalised products may be commissioned upon request.
(2) Custom orders are created according to the specifications agreed upon with the customer. The customer is responsible for ensuring that all requested information is complete and accurate.
(3) In accordance with Section 312g (2) No. 1 of the German Civil Code (BGB), there is no statutory right of withdrawal for goods that have been custom-made or personalised.
(4) Changes or cancellations of custom orders are only possible until production has begun. Once production has started, cancellation is generally no longer possible.
8. Retention of Title
The goods remain the property of Adela Ceramics until full payment has been received.
9. Liability
(1) We shall be fully liable for damages resulting from injury to life, body or health, as well as in all cases where liability is mandatory under applicable law.
(2) In all other cases, we shall only be liable in cases of intent or gross negligence. In cases of slight negligence, we shall only be liable for the breach of an essential contractual obligation (cardinal obligation), and only for the foreseeable damage typical of the contract.
(3) The above limitations of liability shall not apply if we have fraudulently concealed a defect or expressly guaranteed a particular quality of the goods.
10. Final Provisions
(1) The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection provisions require otherwise.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships shall be the registered place of business of Adela Ceramics.
(3) Should any provision of these Terms & Conditions become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
11. Online Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform, which is available at: https://ec.europa.eu/consumers/odr/
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
